Costs and commission

What does the estate agent cost me when I sell?

Commission is only payable if a purchase contract is concluded. We agree the amount and split in writing in advance. For flats and single-family houses, the statutory split applies: if both parties pay, they pay equal shares (section 656c BGB).

How does the statutory commission split work?

When a flat or single-family house is sold to consumers, there are two models: either both parties engage the agent and pay the same amount, or only one party engages the agent and may pass on at most half to the other party – and only once it has paid itself (sections 656c and 656d BGB).

Who pays when a property is let?

The party who engaged the agent (Bestellerprinzip). If the landlord engages the agent, the landlord pays. The commission may not exceed two months’ net rent excluding service charges, plus VAT.

What does the market price assessment cost?

Nothing. The assessment is free of charge and non-binding.

Valuation and price

How do you determine the price?

We view the property, evaluate the documents and compare them with current market data such as standard land values and property market reports. From this we derive a price range and explain our reasoning to you.

Why not simply start with a high price?

A price that is too high often leads to few enquiries and a long marketing period. Long marketing periods act as a warning signal to prospective buyers and can push down the eventual price.

Is your assessment a formal valuation report?

No. It is a market price assessment, not a valuation report on the market value under section 194 of the Federal Building Code (BauGB). If you need a formal report, we will tell you who can prepare it.

Documents

Which documents do I need for the sale?

Among others, a land register extract, energy performance certificate, floor plans and living space calculation; for owner-occupied flats also the declaration of division (Teilungserklärung), minutes of the owners’ meetings, the annual budget (Wirtschaftsplan) and the annual statement of accounts. You will find a complete list in our checklist. We can obtain many of these with your power of attorney.

Do I need an energy performance certificate?

Yes, as a rule. When selling and letting, the energy performance certificate must be available at the latest at the viewing, and advertisements must include information from it (section 87 GEG). Exceptions apply, for example, to listed buildings.

Contract and process

What form does the brokerage agreement take?

When flats and single-family houses are sold, the brokerage agreement must be concluded in text form (section 656a BGB). We conclude every brokerage agreement in writing or in text form and explain it beforehand.

Can I cancel the brokerage agreement?

If the agreement is concluded outside our business premises or exclusively by means of distance communication, consumers have a 14-day right of withdrawal. You receive the cancellation policy with the agreement.

How long does a brokerage agreement run?

We agree the term with you. It is set out in the agreement together with the termination rules.

How long does a sale take from the initial consultation to the notary?

That depends on location, condition, price and the market situation. After the viewing we can give you a realistic estimate of the time frame.

Responsibilities

Who draws up the purchase contract?

The purchase contract is drafted and notarised by a notary. We prepare the information, coordinate the draft with you and accompany you to the appointment.

Do you also give tax advice?

No. Please discuss tax questions, for example regarding the speculation period, with your tax adviser. However, we will point out if something should be checked.

Is Corpus Makler licensed?

Yes. Corpus Callosum Dienstleistungsgesellschaft mbH holds a licence under section 34c of the German Trade Regulation Act (Gewerbeordnung). You will find the details in our legal notice (Impressum).

Can the property be managed afterwards?

Yes. If you wish, Corpus Hausverwaltung takes over the rental management or the management of individual units (Sondereigentumsverwaltung).

Inheritance and special situations

I have inherited a property. What do I need to do first?

Secure the property, inform the buildings insurer and have the land register corrected in favour of the heirs. Within two years of the death this is free of charge at the land registry. More in our guide.

Can a community of heirs sell if not everyone agrees?

A private sale requires the consent of all co-heirs (§ 2040 BGB). Without agreement, the only option is a partition auction, which often brings worse results. A neutral estimate of the value often helps to reach agreement.

How high is the real estate transfer tax in NRW?

6.5 per cent of the purchase price (as of November 2026). It is usually paid by the buyer. More in our guide to purchase costs.
